at a school in san jose. nbc bay area's marianne favro has been following the story and joins us live from the st. francis cabrini school with the developments. >> reporter: the pastor here at st. francis cabrini church has resigned. we now mow more about the letter from the diocese of san jose that enabled a registered sex offender to volunteer here near kids. this is the letter signed by human resources employee at the diocese of san jose that authorized mark gurries, a registered sex offender to volunteer at st. francis cabrini and parish. and that's what he did that parents say hundreds of kids attended. they blame the letter that allowed him to volunteer. >> it's a statute that we do not agree with. what you have is a registered sex offender that was on school grounds. however, it is in the penal code, it is in the books that if you have permission from a school official, you can be on grounds. >> reporter: the diocese says a former human resources employee wrote the letter in november 2010, just six months after he was sentenced for molesting a child under 14. but the diocese wouldn'

in sunnyvale marianne favro, nbc bay area news. >>> more san jose police officers are resigning fed up with lower wages and benefits. in the last two weeks alone, eight more officers announced they are leaving the department. nbc bay's damian trujillo joins us from headquarters. not long ago, this was among the best departments in the country. where is it going from here? >> reporter: morale asinking here and it's been difficult. it remains a strong department but getting more and more difficult by the moment. the chief sent this memo to city hall, alerting them that the number of officers he has available to suit up has dropped to less than 1,000. that number alarming to those victims of crime and to those still here on the force. the robbers haven't been back to the west coast wheels and tire shop in san jose but left an impression with one of the workers tied with duct tape and held at gun point while they em tied the cash register. >> i think about it all the time. >> reporter: police haven't caught the bad guys, with fewer investigators they may never. for the first time in a long

, one of the suspects in a violent strings of crime in san jose will go in front of the judge for the first time. jonathan wilbanks is facing charges of murder, attempted murder and robbery. now, he and another man are accused of four robberies, a deadly attempted carjacking and a shooting that injured a police officer friday night. now, the two of them were caught on surveillance video at a 7/11 store where a man was shot and killed by the suspect. a $20,000 reward is being offered for information for the man who is still out there on the loose. >>> people in palo alto are being warned about two different scams involving energy and water services. the first one involves someone claiming to be from a gas company they claim a product they are selling lowers your bill. the city says the scammers often mention pg&e. that's not palo alto's utility company. the other scam involves a fake water leak insurance company and that will offer insurance against high water bills, they claim. >>> sal, this is your day. i mean, it's gonna be a busy day. >> i was trying to look at the chp list

, jn thin on this wilbanks of san jose. they say he and another man were involved in four armed robberies a fatal shooting and a gun battle with police. >> anyone who is willing to take part in four armed robbery and shooting at an officer is as dang rouse as he gets. >> he they first robbed a little caesar's pizza and 15 minutes later a gas station. an hour after that a jack-in-the-box followed by a spa all within a 12-mile radius. after the robberies, police say wilbanks and a second suspect went to a store on kiwi boulevard and shot and killed a man during an attempted carjacking. the 22-year-old victim died in the parking lot where people have left flowers and notes in his memory. their friends said that he is a good person and great friend who was in the wrong place at the wrong time and they hope police catch the second suspect and soon. san jose police were able to arrest the first suspect, 26-year-old wilbanks on friday night after a pursuit and shootout with officers. >> basically a good old fashioned gun bat until the intersection. >> reporter: during the exchange one
teachers is charged with sexual abusing a student. marianne favro is live in san jose with the latest for us. marianne, this case is now in the hands of the jury. >> reporter: that's right. the jury received the case late this morning. and so far there is no verdict. but some say regardless of the outcome, this case is going to change the way that local schools handle any reports of abuse. she was a principal here at o.b. whaley elementary school in san jose. now lyn vijayendran shown here in a video off a social website faces six months in jail if a jury finds her of fating to report alleged child abuse. the abuse happened in october of last year. police later arrested craig chandler. he is charged with committing lewd and lascivious acts on five children and is now awaiting trial. this is only the second time in 20 years santa clara prosecutors have gone after a local educator for not reporting suspected abuse. >> her response was not to do anything. she did speak with mr. chandler and she kind of conducted her own investigation and determined that there was nothing to be done. >> r

popular. concord, livermore. oakland, 54. san jose, 52. san francisco, 56. we could cot all the specks of rain on high definitely doppler right now quickly because there are zero. there will be zero for a while. when we change back to a wet pattern it's going to be an abrupt one and we'll see a lot of rain toward the middle of the next week. 13% above normal for oakland. below normal for livermore and san jose. everybody getting a lot of rainfall toward the middle of next week. we're seeing a lot of rainfall in the pacific northwest. november, raining up there. but high pressure is taking that thin band of rainfall and keeping it well to the north. we can say thank you to the high pressure because it's giving us the temperatures in the low 70s over the weekend with mainly sunny skies. as soon as the high moves out, the storm track will sag down in to northern california and really change our weather from very sunny to very wet or very stormy. that pattern change will happen next week specifically next wednesday and for about five straight days we're going to see a chance of rain. enjoy
